Terms of Service

ZetaGems is not a retail jewelry shop. All pieces are created through a private, consultative process. Capacity is deliberately limited. We reserve the right to decline any inquiry or commission at our sole discretion without obligation to provide a reason.

The Site is informational and serves as a gateway for private inquiries only. No products are available for immediate purchase, and no shopping cart or open e-commerce functionality exists.

Submitting an inquiry does not create a binding contract. A commission begins only when both parties have agreed in writing (email is sufficient) on the scope, materials, timeline, and price, and any required deposit has been received.

Typical stages include:

• ✦Design proposal and material selection
• ✦Deposit and formal commissioning
• ✦Creation, activation, and delivery

Timelines are estimates only and may vary depending on materials, celestial considerations, and the complexity of the work.

Prices are quoted individually and confirmed in writing before work begins. A non-refundable deposit (typically 50%) is required to secure the commission and commence work. The remaining balance is due prior to shipment or hand-delivery.

Because each piece is made to order and infused with specific intention and materials, deposits are non-refundable once work has begun, except in cases of material non-performance by ZetaGems.

All payments are to be made by the methods agreed in the commissioning correspondence. Prices are generally quoted in USD unless otherwise stated.

Every commissioned piece is unique. Materials, sigils, proportions, and energetic attunement are selected for the individual client. Once creation has begun, the piece cannot be returned, exchanged, or cancelled for change of mind, aesthetic preference, or similar reasons.

If a piece arrives damaged in transit, please notify us within 7 days of receipt with photographic evidence. We will arrange repair or replacement at our discretion where the damage is not caused by the client.

Natural gemstones and handcrafted elements may contain slight variations; these are inherent characteristics of the materials and process and are not considered defects.

All designs, sigils, symbols, compositions, photographs, videos, text, logos, and other creative content on the Site or embodied in any ZetaGems piece remain the exclusive intellectual property of ZetaGems / Darya Anuka, unless and until ownership of a specific physical piece is transferred to the commissioning client upon full payment.

Ownership of a completed physical piece transfers to the client upon receipt of full payment. However, the underlying design, any original sigils, the artistic process, and all photographic or video documentation remain the property of ZetaGems. Clients may not reproduce, commercially exploit, or authorize others to reproduce the design or sigils without prior written consent.

You may not copy, download, screenshot for commercial use, reverse-engineer, or create derivative works from any content on the Site or from any ZetaGems design without our express written permission.

ZETAGEMS is a trademark of Darya Anuka. Unauthorized use is prohibited.

ZetaGems pieces are created as wearable alchemical art and personal intention tools. Any descriptions of frequency, protection, transformation, balance, or other experiential or energetic qualities are expressions of the artist’s practice and the reported experiences of previous recipients. They are not medical, psychological, therapeutic, or scientific claims.

Results are subjective and vary by individual. ZetaGems makes no guarantees regarding health, emotional, spiritual, financial, or life outcomes. The pieces are not a substitute for professional medical, psychological, or legal advice.

To the fullest extent permitted by law, ZetaGems, Darya Anuka, and their representatives shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the Site, any inquiry, or any commissioned piece — including but not limited to loss of profits, data, goodwill, or other intangible losses.

Our total liability for any claim arising from a commissioned piece shall not exceed the total amount actually paid by you for that specific piece.

Nothing in these Terms excludes or limits liability for death or personal injury caused by negligence, fraud, or any other liability that cannot be excluded under applicable law.

You agree not to:

• ✦Use the Site for any unlawful purpose
• ✦Attempt to gain unauthorized access to any systems or data
• ✦Scrape, harvest, or systematically collect content or contact information
• ✦Submit false, misleading, or harassing inquiries
• ✦Impersonate any person or entity

We reserve the right to refuse service or block access at our discretion.

The Site may contain links to third-party websites or services (including YouTube, Facebook, Formspree, or hosting providers). We are not responsible for the content, privacy practices, or terms of those third parties. Your interactions with them are governed by their own policies.

These Terms are governed by the laws of the State of Florida, United States, without regard to conflict-of-law principles. Any dispute arising out of or relating to these Terms or a commission shall first be attempted to be resolved amicably through good-faith discussion. If unresolved, exclusive venue shall be the state or federal courts located in Florida.

We may update these Terms from time to time. The “Last updated” date at the top of this page will reflect the most recent version. Continued use of the Site after changes constitutes acceptance of the revised Terms. For active commissions, the Terms in effect at the time the deposit was received will generally continue to apply unless both parties agree otherwise in writing.
